Chancel Searches Explained: The Hidden Cost Some Buyers Miss

A chancel search checks whether you could be responsible for paying towards repairs to a local church. It may sound surprising, but this is a genuine legal issue that can affect property owners in England and Wales.


What Is Chancel Repair Liability?


Chancel repair liability dates back to medieval times, when property owners took over responsibility from monasteries for maintaining parts of local churches. This law still exists today and means some homeowners may be required to contribute to repairs to the chancel, the area around the altar.


It is estimated that around 500,000 properties in England and Wales could still be affected. Importantly, this liability applies to the land itself, not just older buildings, meaning newer homes can also be impacted.


Around 5,200 pre Reformation Church of England and Church in Wales parishes may still be able to request contributions from affected homeowners. These owners are known as lay rectors and can be asked to help keep the church chancel windproof and watertight.


Are Chancel Searches Mandatory?


This type of search is not always required, but it can be important depending on where you are buying. Your solicitor will usually advise whether a chancel search is recommended based on the property’s location and legal history.


Some buyers assume this issue disappeared in October 2013. However, this is not the case. What changed was how liability is registered:


• Churches could no longer register new interests after 31 October 2013 without adding them to Land Registry records

• Any liabilities registered before this date can still apply today

• Properties affected before 31 October 2013 may still carry the risk
